1. General Terms and Conditions
1.1 These terms and conditions ( T&C
or Terms
) govern the terms under which you will avail of Maya Suki Credit. By activating and applying for Maya Suki Credit, you agree to be bound by the Terms.

refer to Maya Bank, Inc. with its employees, directors, affiliates (Maya Philippines, Inc. shall be considered as an affiliate of Maya Bank for purposes of this T&C), successors, service providers, agents, and assigns. Maya Bank is duly authorized to engage in the business of providing loan products.
1.3 The terms you
and your
refer to the applicant of Maya Suki Credit including the authorized representative/s of the applicant. For avoidance of doubt, the term applicant
shall refer to the natural person (e.g. sole proprietor) or legal entity (e.g. partnership or corporation) who applied for or availed of the Maya Suki Credit.
1.4 These T&C shall be effective, valid, and binding from the time that you signify your agreement to these Terms and will be in full force and effect up to the time that it is terminated by you or us, save for some provisions which shall remain effective after termination, as stated in this T&C, under any law, rule, or regulation.
2. Definition of Terms
2.1 Borrower – the person / party who borrowed money from Maya Bank.
2.2 Cooling Off Option – the Borrower shall have 5 days from the day the loan is granted to cancel such loan, without penalty.
2.3 Loan Amount – maximum amount of loan that you may avail.
2.4 Disclosure Statement (DS) – the form that details all the loan information that you agree upon application, as Required under R.A. No. 3765, otherwise known as Truth in Lending Act

2.5 Due Date – the maturity date or the last day of the loan after which the loan will default.
2.5 Effective Date – shall refer to the date when Maya Bank approves the Loan and you accept these Terms.
2.7 Installment – regular payments done by you to Maya Bank to pay off the loan following the installment payment schedule approved by Maya Bank and accepted by you.
2.8 Loan Amount or the Principal Amount – is the face value of the loan or the amount borrowed.
2.9 Maya Business Manager – application that serves as the interface between you and Maya Bank, which terms of use shall be in accordance with the Terms and Conditions and User’s Guide found in the said App or Website.
2.10 Principal – the business or business owner who refers the Borrower to Maya to avail of the Maya Suki Credit.
2.11 Maya Suki Credit – a loan product offered by Maya to its business clients whereby it allows its clients or third party business owners who are part of its business distribution to apply for a loan which loan may or may not be guaranteed by the principal.
2.12 Total Amount Due or Amount Due – the total amount due you owe Maya Bank that shall constitute your principal amount, service charges, penalties, and applicable fees.
3. Activation and Availment of Maya Suki Credit
3.1 At your own discretion, you applied for a Maya Suki Credit through the Maya Bank channel. You warrant that all the information you provided in your account are valid, true, and correct. You also agree that any information or documents provided in support of the loan application shall remain property of Maya Bank.
3.2 You agree to periodically provide your updated duly stamped received Income Tax Returns, if applicable, to Maya Bank, along with any supporting financial documents that Maya Bank may require. You agree to waive your confidentiality on the aforementioned documents and authorize Maya Bank to verify, at any time, the authenticity of the submitted documents with the Bureau of Internal Revenue.
3.3 You agree that Maya Bank will validate such submission with available information on the applicant’s accounts, credit information, and credit status from applicable entities, Banks and Financial Institutions, and Credit Bureaus, and other applicable institutions.
3.4 You authorize the holder, controller, and processor of the information from the foregoing sources to confirm, release and verify the existence, truthfulness, and/or accuracy of such information to Maya Bank.
3.5 You warrant that incomplete and/or inaccurate information in your account will result to delay or disapproval of your loan application. If Maya Bank discovers that you declared an inaccurate information or misrepresentation, which is material in the approval of your application, Maya Bank has the right to terminate the loan and demand immediate payment of any outstanding amount in accordance with the law.
3.6 You agree to notify Maya Bank in the event that there has been a material charge in any of the information or documents previously provided to Maya Bank.
3.7 Maya Bank reserves the right to approve or reject availments of Maya Suki Credit and has no obligation to disclose reasons for the rejection or disapproval of such application. Maya Bank has the sole discretion to approve only a portion of the amount availed of.
4. Loan Proceeds
4.1 Upon approval of your application, loan proceeds will be viewable via your Maya Account.
4.2 The Cooling Off Option shall only be availed once. Upon availment of such option, the loan cannot be re-opened and Borrower must submit a new application in case the Borrower would like to avail of another loan and avail of the Cooling Off Option.
4.3 For Principal-endorsed lines, you may only use your approved line with eligible and approved QR codes provided for by Maya Philippines. You authorize Maya to disclose the status, amount of your loan and loan information to the Principal as part of this product feature.

4.3.2 You hereby agree and covenant that the loan proceeds shall be used exclusively for the purposes disclosed to Maya. You are strictly prohibited from using the loan proceeds for any other purpose not explicitly disclosed and approved by Maya. Any deviation from the disclosed purposes without prior written consent from Maya shall constitute a breach of this agreement, and Maya reserves the right to take appropriate legal action, including but not limited to demanding immediate repayment of the loan in full.
5. Interest, Fees, and other Charges
5.1 You agree to applicable interest charges, fees, and other applicable charges stated in the Disclosure Statement. Such applicable interest charges, fees, and other charges may change over time, subject to existing laws and regulations.
5.2 If you have clarifications on the amount due or any information in your account, please report your concerns through Maya Bank Hotline found in Maya Business Manager and at mayabank.ph within ten (10) calendar days from transaction date. Otherwise, the amount due or information stated in the Maya Business Manager shall be deemed accurate and conclusive.
5.3 The amount due as reflected in your account in the Maya Account should be paid on or before the due date stated therein. If on the due date your loan is still unpaid, Maya Bank has the option and right to automatically deduct your Total Amount Due from your Maya Account until your loan has been fully settled and without need of notice. You acknowledge that Maya Bank will not be liable for any losses, damages, expenses, costs or charges whatsoever which may be claimed against Maya Bank arising from such automatic debiting.
5.4 In case of failure to pay outstanding loan on or before the due date, you agree to pay penalty in the amount stated in the Disclosure Statement, in addition to interest charges and other fees. The penalty will be calculated from the day immediately following the due date until full and final settlement of the Total Amount Due.
5.5 You waive any rights under Article 1252 of the Civil Code of the Philippines and agrees that any payment made by you to Maya Bank for the purpose of early repayment of any Amount Due shall be applied in the following order: (i) penalties, (ii) fees, charges and interest (iii) principal and thereafter against any other obligations to Maya Bank, if any.
5.6 Early Repayment. – Subject to the payment of all accrued daily interest, charges, penalties, or Amounts Due, you are entitled to repay early the Total Amount Due or a portion of it, at any time before its Due Date. In case of overpayment, the amount paid in excess will be applied as payment against the outstanding principal in the following periods. For avoidance of doubt, penalties may still be incurred in the event that the subsequent installment of the principal is not paid in full on or before its due date. You may refer to your Maya Business Manager for the exact amount due and computation.
5.7 In the event Maya Bank shall be required to pay any taxes or other fees on or with regard to the execution, formalization or perfection of any documentation contemplated hereunder or delivered pursuant hereto, you shall, upon notice, reimburse Maya Bank for such taxes or fees paid.
6. Representations and Warranties
6.1 You represent and warrant that: (i) you are of legal age, of sound mind, able to contract in any kind of contract, possesses no legal disability to apply for a Loan, and possesses no legal disability to accept these Terms nor any criminal record of any kind; (ii) your loans and obligations with other banks, lending, financing or credit card companies and the like are updated and not delinquent as of Effective Date; (iii) all documents you submitted are current, authentic, and may be relied upon by Maya Bank as of Effective Date; (iv) All oral representations and communications you made to Maya Bank remain true, correct and accurate as of Effective Date; and (v) you entered into the loan agreement willingly and without influence or duress from any party.
6.2 You agree that it is your responsibility to securely keep your PIN and/or Password. The use of your User ID, PIN and/or Password including one-time passwords (OTPs) will serve as your irrevocable authorization for us to carry out transactions that you initiated. Any fraudulent or negligent activity by your agents, employees, officers, and authorized representatives using your User ID, your PIN, Password and/or OTP, such as but not limited to unauthorized withdrawals or transfers, that may bring about financial losses to you is your sole responsibility.
6.3 These Terms and other documents and instruments mentioned and related hereto, when executed, shall be valid and binding upon you and enforceable in accordance with the respective terms and conditions hereof.
7. Covenants
7.1 As long as any of the Loan Amount remains outstanding and unpaid, you shall: (i) punctually pay all Installments and perform all other obligations, undertakings and covenants hereunder and shall not allow any of the Installments to be default in any way; (ii) submit documents and provide information which may be required by the government regulators or Maya Bank at any time; (iii) notify Maya Bank for every change of data by updating your account in Maya Business Manager immediately after such change; and (iv) execute and deliver such other instruments and documents as may be requested by Maya Bank to give full force and effect to these Terms and other documents and instruments executed in connection therewith or to comply with Maya Bank’s internal policies.
8. Disclosure of Information
8.1 You allow Maya Bank to use any of the information you provided to Maya Bank and/or gathered by Maya Bank in the course of your application or at any time during the period of your loan.
8.2 You allow Maya Bank to obtain or update your information with the credit bureau or other external parties, and as well as any government agencies, such as but not limited to, the Credit Information Corporation, Social Security System, Government Service Insurance System, Bureau of Internal Revenue and Department of Labor and Employment, for collection purposes.
8.3 You allow Maya Bank to disclose your information to collection agencies, counsels, or other agents of Maya Bank in the event that Maya Bank is constrained to enforce its rights against you.
9. Collection
9.1 Subject to and not in derogation of its rights under these Terms, Maya Bank shall have the right, at its sole discretion, and when it deems necessary to appoint and authorize an agent of its choice and on its behalf to collect all and any sums due to Maya Bank from you. Such authorization shall be subject to a written notification by Maya Bank to you at least seven (7) days prior to the actual endorsement, in compliance with the requirements of applicable laws, rules, and regulations.
9.2 If Maya Bank hires the services of an attorney and/or collection agencies, to collect the obligations in this T&C and the loan agreement and incur expenses arising from the same, Maya Bank shall be entitled to recover from you, any and all attorney’s fees and agency fee, in the amount incurred in connection with the collection of the Loan Amount.
10. Events of Default
10.1 Each of the following events constitutes an Event of Default, irrespective of the reason for its occurrence and whether it is voluntary or involuntary or occurs as a result of any court order, law or regulation:
- Failure to promptly and fully pay any Installment or failure to pay, when due, any of the interest on the Loan Amount and/or other charges and fees when any of such falls due, and/or fails to properly perform any of the obligations arising from these Terms, other documents and instruments mentioned and related hereto, or violates any covenants or provision of these Terms, other documents and instruments mentioned and related hereto;
- Submission to Maya Bank of any false or inaccurate information, representation or warranty, or document;
- Failure to update material information in your account;
- Commission or threaten to commit a default or breach of any covenants, stipulations, terms or conditions contained in these Terms or the documents pertaining to the loan;
- Use of the loan proceeds for any other purpose or there is a reasonable suspicion you applied for a loan in order to defraud Maya Bank;
- Failure to furnish any information or documents required by Maya Bank;
- Death or you become incapacitated to pay your obligations;
- These Terms cease to be legal, valid or binding obligation because of change in law or regulations; or
- Any other circumstance occurs which gives reasonable grounds for Maya Bank to believe that you may not be able to perform its obligations under these Terms.
11. Consequences of Default
11.1 If an Event of Default occurs, then at any time thereafter, Maya Bank may, at its sole discretion, without need of notice or demand:
- Impose collection of charges, fees and interest or penalties as stated in the Disclosure Statement. These penalties shall be cumulative and be added to the principal obligation for computation of each payment schedule or amortization.
- Declare the loan and all obligations, including the Loan Amount, all charges, fees, interest, and penalties accrued and unpaid thereon, to be immediately due and payable, without need of demand or further notice of any kind, all of which are herein expressly and specifically waived by Maya Bank. At its option, take such action and exercise such remedies in order to protect and enforce its rights under the T&C and the loan agreement.
- Have the right to exercise, alternatively, successively, concurrently and cumulatively, any and all other rights and remedies now or hereafter available to it under this T&C and the loan agreement and the applicable laws.
12. Non waiver of rights
12.1 Acceptance by Maya Bank of any payment after its Date Due or after an Event of Default has occurred or after legal proceedings have been commenced against you shall not constitute an extension of time for payment or a modification or novation of the terms of these T&C and the loan agreement or in any way prejudice or adversely affect Maya Bank’s cause of action against you.
12.2 Failure, omission, or delay on the part of Maya Bank to exercise its right or remedies under these Terms and Conditions shall not operate as a waiver. Any such waiver shall be valid only when reduced in writing and delivered to you.
13. General Provisions
13.1 Maya Bank has the sole right to increase or decrease your credit limit, service charges, fees, and interest rate. Maya Bank also has the right to offer you different product features/services and/or promos.
13.2 Maya Bank retains the sole right to terminate your account as well as determine, modify, change, increase or decrease your Maya Suki Credit limit without need of notice.
13.3 All notice requirements shall be as stated in these Terms. If Maya Bank is required to send notice to you, it shall do so through available channels including but not limited to, In-App notifications, SMS, email, or registered mail which shall be sent to your registered address. Publication in Maya Bank’s website shall also be sufficient notice, as may be required by this Terms and the loan agreement. All notices and communications to you by Maya Bank through any of the foregoing channels shall be deemed to have been duly given: (i) at the time of sending of the SMS or email, provided that no delivery failure notification is received by the sender within 24 hours of sending such notice or communication; (ii) three (3) business days after being deposited in the mail, if by registered mail; or (iii) the following business day from date of publication in Maya Bank’s website.
13.4 Maya Bank has the right, at its option, to sell, transfer or assign any of its rights and obligations hereunder to any person, company or entity without need of consent. Any such sale, assignment, or transfer shall conclusively bind you. You shall be bound to fulfill and perform all your obligations to such transferee or assignee, including the payment of the Installments. The transferee or assignee shall have the authority to collect the due amount.
13.5 Maya Bank has the absolute right to terminate the loan agreement together with any other document executed between you and Maya Bank after 30 days written notice, if for any breach any of the terms and conditions of the T&C or the loan agreement. The Bank also has the right to stop or refuse disbursement if you are in breach of the Terms or if there are indications of insolvency.
13.6 Maya Bank reserves the right to amend any of the terms and conditions contained under these Terms, provided that such change will be communicated to you.
13.7 In case any provision of these Terms shall be declared to be invalid, illegal or unenforceable in any respect, the validity, legality or unenforceability of any other provision therein shall not in any way be affected or impaired thereby.
13.8 These Terms shall be construed and governed in accordance with the laws of the Philippines.
13.9 In case of any dispute arising out of these Terms or your use of the Services, you hereby agree, undertake, and commit to resolve or attempt to resolve such dispute promptly and in good faith. In case of failure to resolve any such dispute, you agree to the jurisdiction by and venue in the appropriate courts of Mandaluyong City, Philippines, to the exclusion of all other courts, and waive as you hereby waive, any objection to such jurisdiction or venue.
14. Customer Service
At Maya Bank, we consider our customer’s financial questions, needs and feedback as very important. If you have any concerns about a procedure or have encountered a problem with our service, we will do our best to address it within ten (10) days. 1. General Terms and Conditions
1.1 These terms and conditions (“T&C” or “Terms”) govern the terms under which you will avail of the loan products of Maya Bank through its Mini Payments for Partner Brands service. By availing, activating and applying for Mini Payments for Partner Brands, you agree to be bound by the Terms. The General Terms and Conditions (GT&Cs) of Maya Bank accessible through this link: https://mayabank.ph/terms-conditions/ are deemed incorporated into thise T&C. In case of conflict or inconsistency between the GT&Cs and these T&C, the terms of these T&C shall prevail.
1.2 Under these T&C, the terms “Maya Bank”, “Maya”, “we”, “us”, and “our” refer to Maya Bank, Inc. with its employees, directors, affiliates, successors, service providers, agents, and assigns. Maya Bank is duly authorized to engage in the business of providing loan products.
1.3 The terms “you” and “your” refer to the applicant of Mini Payments for Partner Brands.
1.4 These T&C shall be effective, valid, and binding from the time that you signify your agreement to these Terms or you have availed any of Maya Bank’s products or services, including the Mini Payments for Partner Brands services, and will be in full force and effect up to the time that it is terminated by you or us, save for some provisions which shall remain effective after termination, as stated in this T&C, under any law, rule, or regulation.
2. Definition of Terms
2.1 Affiliates – refers to any person or entity controlled by or under common control with another person. For purposes of the Terms, any of the entities under the MVP Group of Companies, including but not limited to PayMaya Philippines, Inc., PLDT, Inc., Metro Pacific Investments Corporation, Smart Communications, Inc., The Manila Electric Company, Maynilad Water Services, Inc., Metro Pacific Tollways Corporation, and Media Quest Holdings, Inc. shall be considered as Affiliates of Maya Bank.
2.2 Agreement – refers to the agreement between Maya Bank and Customer in relation to the Mini Payments for Partner Brands transaction.
2.3 Mini Payments for Partner Brands – refers to the Buy Now Pay Later service of Maya Bank wherein goods and/or services can be purchased from a Merchant by the Customer, payable in the future through one or more Installments. This also refers to the Mini Payments for Partner Brands service.
2.4 Customer – refers to the person / party who avails of Mini Payments for Partner Brands from Maya Bank.
2.5 Credit Limit – refers to the maximum amount assigned to you which you may use to purchase goods/services through the Mini Payments for Partner Brands.
2.6 Disclosure Statement (DS) – refers to the form that details all the Mini Payments for Partner Brands transaction information that you agree upon application.
2.7 Due Date – refers to the last date for payment of the Total Amount Due. After which, the Mini Payments for Partner Brands becomes delinquent and is subject to penalty fee.
2.8 Effective Date – refers to the date when Maya Bank approves the Mini Payments for Partner Brands application and you accept these Terms.
2.9 Installment – refers to the portion of your Principal Amount and the interest/fee component (if any) that you must pay to Maya Bank every Due Date, as stated in the installment payment schedule in your Disclosure Statement, which was approved by Maya Bank and accepted by you.
2.10 Interest – refers to the interest rate that may be charged on the Principal Amount of your Mini Payments for Partner Brands transaction. Exact interest rate is disclosed through the Maya App and/or Merchant, and will also be indicated in your Disclosure Statement.
2.11 Notice of Payment – refers to the notification sent by Maya Bank through in-App notifications, and/or SMS (and other similar channels), and also accessible in Maya App, to inform the Customer of the Total Amount Due for the Mini Payments for Partner Brands transaction and the Due Date thereof.
2.12 Principal Amount or Loan Amount – refers to the face value of the goods and/or services purchased from a Merchant by the Customer and financed by Maya Bank through Mini Payments for Partner Brands.
2.13 Maya App – refers to the mobile application that serves as the interface between you and Maya Bank, which terms of use shall be in accordance with the Terms and Conditions and User’s Guide found in the said Maya App or Maya Bank Website.
2.14 Merchant – refers to the business establishment accredited by Maya Bank to provide goods and/or services that may be purchased by the Customer through Mini Payments for Partner Brands. It shall also refer to the Merchant’s stockholders, officers, managers, employees, and agents.
2.15 Partner Channel – the employer, enterprise, or business, in partnership agreement with Maya Bank, authorized to collect application inquiries and requests related to Mini Payments for Partner Brands from their customers or employees who have provided consent to share their personal information with Maya Bank.
2.16 Service Fee – refers to any applicable fee that may be charged upon purchasing goods using Mini Payments for Partner Brands.
2.17 Total Amount Due – refers to the sum of all amounts payable on the Due Date, inclusive of the following:
- Remaining unpaid installments, if any;
- Billed fees and charges
- Current Installment amount due
2.18 Total Outstanding Balance – refers to the total amount you owe Maya Bank that shall constitute the Principal Amount, interest rate (if any), and applicable fees and charges.
3. Activation and Availment of Mini Payments for Partner Brands
3.1 At your own discretion, you have applied for the Mini Payments for Partner Brands through the Maya App or through checkout powered by Maya. You warrant that all the information you provided in your Maya Bank account are valid, true, and correct. You also agree that any information or documents provided in support of the Mini Payments for Partner Brands application shall remain property of Maya Bank.
3.2 You authorize us to make, directly or through third parties, any inquiries necessary to verify your identity and to assess your capability to make payments in accordance with Mini Payments for Partner Brands policies. You further agree and authorize us to share such information with any company or business entity that is our subsidiary our holding company or a subsidiary of our holding companies (our “Affiliates”) or any other third party as may be relevant or necessary to carry out the above assessment by the Bank.
3.3 You agree to periodically provide your updated duly stamped received Income Tax Returns, if applicable, to Maya Bank, along with any supporting financial documents that Maya Bank may require, from time to time. You agree to waive your confidentiality on the aforementioned documents and authorize Maya Bank or its authorized representative, to verify, at any time, the authenticity of the submitted documents with the Bureau of Internal Revenue, and other appropriate sources, including your employer, if any.
3.4 You agree that Maya Bank will validate such submission with available information on the applicant’s accounts, credit information, and credit status from applicable entities, Banks and Financial Institutions, and Credit Bureaus, and other applicable institutions.
3.5 You authorize the holder, controller, and processor of the information from the foregoing sources to confirm, release and verify the existence, truthfulness, and/or accuracy of such information to Maya Bank.
3.6 You agree that the information in your Maya Bank account may be used by Maya Bank to pre-fill any future Mini Payments for Partner Brands or loan applications in the Maya App.
3.7 You warrant that incomplete and/or inaccurate information in your Maya Bank account will result to delay or disapproval of your Mini Payments for Partner Brands application. If Maya Bank discovers that you have declared any inaccurate information or have made any misrepresentation, which is material in the approval of your application, Maya Bank has the right to terminate the Mini Payments for Partner Brands and demand immediate payment of any outstanding amount in accordance with the law.
3.8 You agree to notify Maya Bank in the event that there has been a material change in any of the information or documents previously provided to Maya Bank.
3.9 Pursuant to Republic Act No. 9510 (Credit Information System Act), the Bank needs to inform the applicant that the credit application was not approved based on its internal credit evaluation, which included a review of available credit information. The applicant may request access to their credit report through accredited credit bureaus to verify the accuracy of submitted data.
3.10 You understand that the Merchant is fully responsible for its services or goods. The sale and purchase of the Merchant’s goods and/or services between the Merchant and the Customer through Mini Payments for Partner Brands shall be a contract between the respective Customer and Merchant. You understand that Maya Bank does not:
- have any part in the performance of the Merchant’s obligations, such as the obligation to provide the goods and/or services or to ship and deliver the same, in the Mini Payments for Partner Brands transaction;
- in any way, own, create, engineer, manufacture, sell, resell, provide, control, manage, offer, deliver, transfer or supply any of the Merchant’s goods and/or services;
- provide insurance of any kind in connection with the Merchant’s goods and/or services; or
- make any representations and warranties of any kind in connection with the Merchant’s goods and/or services, express or implied, including any warranties that the Merchant’s goods and/or services are accurate, complete, reliable current, suitable, fit for purpose or error-free. The loss, damage, or any defects in the goods and/or services supplied by the Merchant pursuant to the Mini Payments for Partner Brands transaction will not release you from any of the obligations imposed pursuant to the Mini Payments for Partner Brands transaction, such as those imposed under this T&C.
In view of the above, You agree to:
- hold Maya Bank free and harmless against any and all claims arising from the use of the goods and/or services, or any and all refund claims or claims related to the quality, warranty, maintenance, and/or after sales services of the goods and/or services subject of the Mini Payments for Partner Brands transaction, with the understanding that Maya Bank has no responsibility in respect of any of these matters;
- hold Maya Bank free and harmless against any and all claims relating to the delivery of the goods and/or performance of the services or arising from any failure, negligence, or delay in respect of the delivery of the goods and/or performance of the services, with the understanding that aforementioned delivery or performance is the sole and exclusive responsibility of the Merchant;
- not assign, transfer, sell, or in any way dispose of the goods subject of the Mini Payments for Partner Brands transaction before full payment of all the Installments; and
- promptly perform all other obligations under these Terms including the payment of the Total Amount Due, notwithstanding any damage to or loss of the goods, or any defects or non-performance of the services provided by the Merchant, any dispute between the Customer and the Merchant, or the existence of any of the claims described in this section, including any claims for refunds. The Merchant’s policies and procedures are binding in the occurrence of any such event.
4. Loan Proceeds
4.1 Upon approval of your application, the loan proceeds will be credited directly to the Merchant for the purchase of the relevant goods and/or services subject of the Mini Payments for Partner Brands transaction.
5. Interest, Fees, and other Charges
5.1 You agree to the applicable interest, fees, and other applicable charges stated in the Disclosure Statement. Such applicable interest, fees, and other charges may change over time, subject to existing laws and regulations.
5.2 You acknowledge the integrity of the Disclosure Statement as an electronic document pursuant to the provisions of the Electronic Commerce Act and agree to pay on the Due Date any amount stated on the Maya App without need for presentation of signed documents.
5.3 Notices of Payment are sent through in-App notifications, and/or SMS (and other similar channels), and also accessible in Maya App, to inform the Customer of the Total Amount Due. The Total Amount Due should be paid on or before the Due Date, as stated in the Notice of Payment. If you have clarifications on the Notice of Payment, please report your concerns through Maya Bank hotline found in Maya App and at https://www.mayabank.ph/. Your right to question any item in the Notice of Payment shall be deemed waived if no such report has been made within ten (10) calendar days from receipt thereof.
5.4 In case of failure to pay the Total Amount Due on the Due Date, you acknowledge that your Mini Payments for Partner Brands will be considered past due and you shall be liable to pay a penalty fee on the unpaid Installment amount per day, in addition to interest and other fees as indicated in the Disclosure Statement. The penalty fee will be calculated from the day immediately following the Due Date until full and final settlement of the unpaid Installment. The Table of Fees may change over time, subject to existing laws and regulations.
5.5 Maya Bank has the option and right to automatically deduct your Total Amount Due from your Maya Consumer App wallet, or any of the accounts (e.g. Maya Savings, Maya Credit, etc.) you presently maintain with us or later create with us until your Total Outstanding Balance has been fully settled and without need of notice. You acknowledge that Maya Bank will not be liable for any losses, damages, expenses, costs or charges whatsoever which may be claimed against Maya Bank arising from such automatic debiting.
5.6 You waive any rights under Article 1252 of the Civil Code of the Philippines and agree that any payment made by you to Maya Bank for the purpose of repayment of any amount due pursuant to the Mini Payments for Partner Brands transaction shall be applied in the following order: (i) penalties, (ii) fees, (iii) interest, (iv) principal and thereafter against any other obligations to Maya Bank, if any.
5.7 In the event Maya Bank shall be required to pay any taxes or other fees on or with regard to the execution, formalization or perfection of any documentation contemplated hereunder or delivered pursuant hereto, you shall, upon notice, reimburse Maya Bank for such taxes or fees paid.
6. Representations and Warranties
6.1 You represent and warrant that: (i) you are of legal age, of sound mind, able to contract in any kind of contract and possesses no legal disability to apply for a loan and accept these Terms nor any criminal records of any kind; (ii) your loans and obligations with other banks, lending, financing or credit card companies and the like are updated and not delinquent as of Effective Date; (iii) any and all documents you may have submitted are current, authentic, and may be relied upon by Maya Bank as of Effective Date; (iv) All oral representations and communications you made to Maya Bank remain true, correct and accurate as of Effective Date; and (v) you entered into the Agreement willingly and without influence or duress from any party.
6.2 You agree that it is your responsibility to securely keep your PIN and/or Password. The use of your User ID, PIN and/or Password including one-time passwords (OTPs) will serve as your irrevocable authorization for us to carry out transactions that you initiated. Any fraudulent or negligent activity by your agents, employees, officers, and authorized representatives using your User ID, your PIN, Password and/or OTP, such as but not limited to unauthorized withdrawals or transfers, that may bring about financial losses to you is your sole responsibility.
6.3 These Terms, the GT&Cs of Maya Bank, and other documents and instruments mentioned and related hereto, when executed, shall be valid and binding upon you and enforceable in accordance with the respective terms and conditions hereof.
7. Covenants
7.1 As long as any of the Loan Amount remains outstanding and unpaid, you shall: (i) punctually pay all Installments and perform all other obligations, undertakings and covenants hereunder and shall not allow any of the Instalments to be default in any way; (ii) submit documents and provide information which may be required by the government regulators or Maya Bank at any time; (iii) notify Maya Bank for every change of data by updating your account in the Maya App immediately after such change; and (iv) execute and deliver such other instruments and documents as may be requested by Maya Bank to give full force and effect to these Terms and other documents and instruments executed in connection therewith or to comply with Maya Bank’s internal policies.
7.2 In availing any of the bank products and services covered under these Terms, you agree to waive, without need of notice, in favor of Maya Bank, including any of its Affiliates, service providers, shareholders, associates, subsidiaries, officers, employees, agents, lawyers, partners, and other consultants, your rights under Section 55.1 (b) of Republic Act No. 8791 (The General Banking Law of 2000), under Republic Act No. 1405, or any other right pertaining to secrecy of bank deposits for any of the following purposes:
- Updating your Maya Bank account upon your request;
- Validating your identity before providing our services, or responding to any of your queries, applications, feedback, and complaints;
- Managing our day-to-day business operations;
- Providing customer service and support;
- Keeping your information updated through our official data touchpoints;
- Performing credit checks or due diligence checks to minimize risks or frauds;
- Safeguarding your account and protect you against fraud and other criminal activity;
- Settling claims or disputes involving any of our products and services;
- Complying with all applicable laws and regulations as well as performing our obligations from any legal authorities;
- Marketing and Credit scoring;
- Updating you on changes to our products or services; and
- For any other lawful purpose that Maya Bank may deem fit or necessary.
8. Disclosure of Information
8.1 You allow Maya Bank to use any of the information you provided to Maya Bank and/or gathered by Maya Bank in the course of your application or at any time during the period of your loan.
8.2 You allow Maya Bank to obtain or update your information with the credit bureau or other external parties, as well as any government agencies, such as but not limited to, the Credit Information Corporation, Social Security System, Government Service Insurance System, Bureau of Internal Revenue and Department of Labor and Employment, for collection purposes.
8.3 You allow Maya Bank to disclose your information to collection agencies, counsels, Affiliates, or other agents or partners of Maya Bank in the event that Maya Bank is constrained to enforce its rights against you.
8.4 You authorize Maya Bank, Affiliates, third-party service providers, and its official partners to collect, hold, use and process the personal information that you have provided directly or indirectly in our data collection touchpoints relevant to the respective purposes furnished to you in our privacy notices. With your active use of our products and services, you agree to the Data Privacy Statement of Maya Bank found in http://www.mayabank.ph/privacy
9. Collection
9.1 Subject to and not in derogation of its rights under these Terms, Maya Bank shall have the right, at its sole discretion, and when it deems necessary to appoint and authorize agent/s of its choice and on its behalf to collect all and any sums due to Maya Bank from you. Such authorization shall be subject to a written notification by Maya Bank to you at least seven (7) days prior to the actual endorsement, in compliance with the requirements of applicable laws, rules, and regulations.
9.2 If Maya Bank hires the services of an attorney and/or collection agencies, to collect the obligations in this Agreement and incur expenses arising from the same, Maya Bank shall be entitled to recover from you, any and all attorney’s fees and agency fee, in the amount incurred in connection with the collection of the Total Amount Due.
10. Refund and Cancellation of Loan
10.1 You may request a refund from the Merchant and the cancellation of your approved Maya Pay Later loan within three (3) business days from the date of loan approval, subject to the following conditions:
- The Merchant has approved your request for refund and cancellation of the underlying sale or transaction; and
- The Merchant has returned to Maya Bank, in full, the Principal Amount and any interest incurred, if applicable, together with a refund fee equivalent to 5% of the Principal Amount, if any.
10.2 Procedure for Loan Pre-termination due to Product Refund. In the event that the Merchant approves a full refund of the Retail Product due to a confirmed defect or non-availability of replacement, the following procedures shall apply:
- 10.2.1 Merchant Remittance: The Merchant shall remit the full refund amount directly to the Bank to settle the outstanding loan balance.
- 10.2.2 Interest Adjustment: Upon receipt of the refund from the Merchant, the Bank shall terminate the loan and recompute the interest. Until the Bank has received the actual refund proceeds from the Merchant, the loan shall continue to earn interest and other applicable fees, if any. The Borrower shall only be liable for the principal amount and the interest accrued up to the date the Bank receives the refund. Any pre-paid interest or excess payments shall be credited to Your Maya Savings account within seven (7) business days.
- 10.2.3 You agree that the obligation to pay all monthly installments and other amounts due to Maya Bank shall remain valid, binding, and enforceable notwithstanding any ongoing coordination or dispute with the Merchant relating to any issues concerning the contract of sale of goods or service or transaction between you and the Merchant.
- 10.2.4 You acknowledge that your decision to withhold or delay payment of your loan pending resolution of a dispute with the Merchant may result in a delinquency, imposition of applicable late payment penalties and shall be reported to the Credit Information Corporation (CIC) or other relevant credit bureaus, in accordance with applicable laws and regulations.
10.3 Right to Full Pre-payment. You may settle the Loan in full at any time before the scheduled maturity date. To initiate a pre-termination, You must pay the total outstanding Principal Balance, along with any unpaid Interest (if applicable) and Fees that have accrued up to the actual date of settlement through your Maya Buy Now Pay Later account.
10.4 Eligibility for Subsequent Loans. You acknowledge that the early settlement of a Loan may not result in the immediate availability of a new credit offer. To ensure responsible credit utilization, You will only become eligible for a new Maya Pay Later loan offer after the original Matuity Date of the pre-terminated loan has passed.
11. Events of Default
Each of the following events constitutes an Event of Default, irrespective of the reason for its occurrence and whether it is voluntary or involuntary or occurs as a result of any court order, law, or regulation:
- Failure to promptly and fully pay the Total Amount Due, including any of the interest on the Principal Amount and/or other charges and fees when any of such falls due
- Failure to properly perform any of the obligations arising from these Terms and other documents and instruments mentioned and related hereto, or violation of any covenant or provision in these Terms and other documents and instruments mentioned and related hereto;
- Submission to Maya Bank of any false or inaccurate information, representation or warranty, or document, as well as the commission of any fraudulent activity;
- Failure to update material information in your account;
- Commission or threaten to commit a default or breach of any covenant, stipulation, term or condition contained in these Terms or the documents pertaining to the Mini Payments for Partner Brands;
- Failure to furnish any information or documents required by Maya Bank;
- Death or incapacity to fulfill your obligations;
- These Terms cease to be legal, valid, or binding obligation because of change in law or regulations; or
- Security breach resulting from your own acts, omission, or negligence affecting Maya Bank or its Affiliates’ systems, processes, or applications; or
- Any other circumstance occurs which gives reasonable grounds for Maya Bank to believe that you may not be able to perform your obligations under these Terms.
12. Consequences of Default.
12.1 If an Event of Default occurs, then at any time thereafter, Maya Bank may, at its sole discretion, without need of notice or demand:
- Impose a collection of interest, penalties, or a one-time penalty as stated in the DS. Penalties in the amount as stated in the DS shall be imposed one time or on a monthly basis, in case of default. These penalties shall be cumulative and be added to the principal obligation for computation of each payment schedule or amortization.
- Declare the loan and all obligations, including the outstanding balance of the Loan Amount, all fees, penalties, and interest accrued and unpaid thereon, to be immediately due and payable, upon written demand. At its option, take such action and exercise such remedies in order to protect and enforce its rights under the Agreement. The account in default will incur Late Penalty Fee on the overdue principal amount and the billed in full Outstanding Principal starting from the day immediately following the Due Date until full and final settlement of the overdue balance.
- Perform collection activities including, but are not limited to, locating you or conducting visits to your home and/or office address. Maya Bank, at its option, may also endorse collection of the outstanding balance of the Loan Amount, all fees, penalties, and interest accrued and unpaid thereon, to a collection agency as may be provided under these Terms.
- Recall and demand repayment of all sums you owe to Maya Bank in respect of other facilities granted by Maya Bank.
- Upon payment default, contact you using the contact details, social media account name, and other methods you provided to Maya Bank, such as, but not limited to, SMS, email, messaging apps, and social media accounts, among others.
- Engage in reasonable means of skip tracing in the case that you are uncontactable via the details or means of contact, and this includes reaching out to nominated contacts, field visits, etc.
- Report your default to the credit bureau, which may affect your rating, and/or take legal action against you.
- Have the right to exercise, alternatively, successively, concurrently and cumulatively, any and all other rights and remedies now or hereafter available to it under this Agreement and the applicable laws.
12.2 Maya Bank may terminate or suspend your Mini Payments for Partner Brands account in case of an Event of Default or in case of any form of breach of these Terms or applicable laws, provided always that you shall remain responsible or accountable for any omission, or actions taken through the use of your Mini Payments for Partner Brands account before such termination or suspension. Maya Bank reserves the right to reactivate or restore your Mini Payments for Partner Brands account at its sole discretion upon your compliance of its requests or upon considering copies of the relevant records or documents provided by you, and at its discretion, Maya Bank may limit, restrict, suspend or terminate your access to its system, application or platform, whether temporarily or permanently.
13. Non waiver of rights
13.1 Acceptance by Maya Bank of any payment after its Due Date or after an Event of Default has occurred or after legal proceedings have been commenced against you shall not constitute an extension of time for payment or a modification or novation of the terms of this Agreement or in any way prejudice or adversely affect Maya Bank’s cause of action against you.
13.2 Failure, omission, or delay on the part of Maya Bank to exercise its right or remedies under these Terms and Conditions shall not operate as a waiver. Any such waiver shall be valid only when reduced in writing and delivered to you.
14. General Provisions
14.1 You understand that the Merchant is solely and exclusively liable for any obligations arising from and in connection with the provision of the goods and/or services subject of the Mini Payments for Partner Brands transaction. Any additional fees charged by the Merchant in connection with the Mini Payments for Partner Brands transaction are charged or imposed by the Merchant in its sole discretion and do not represent any fees charged or imposed by Maya Bank to you.
14.2 Maya Bank has the sole right to increase or decrease your Credit Limit and interest rate. Maya Bank also has the right to offer you different product features/services and/or promos. Maya Bank reserves the right to vary the method of calculation of service fee, interest rate, and any other applicable fees, charges or levies provided for herein for any reason whatsoever (whether arising from the change in your risk profile or otherwise) including the effective date of any such change with reasonable notice to you.
14.3 All notice requirements shall be as stated in these Terms. If Maya Bank is required to send notice to you, it shall do so through available channels including but not limited to, In App notifications, SMS (and other similar channels), email, or registered mail which shall be sent to your registered address. Publication on Maya Bank’s website shall also be sufficient notice, as may be required by this Agreement.
14.4 Maya Bank has the right, at its option, to sell, transfer or assign any of its rights and obligations hereunder to any person, company, or entity without need of consent. Any such sale, assignment, or transfer shall conclusively bind you. You shall be bound to fulfil and perform all your obligations to such transferee or assignee, including the payment of the Instalments. The transferee or assignee shall have the authority to collect the due amount.
14.5 Maya Bank has the absolute right to terminate the Agreement together with any other document executed between you and Maya Bank at any time if for any breach any of the terms and conditions of the Agreement.
14.6 Maya Bank reserves the right to amend any of the terms and conditions contained under these Terms, provided that such change will be communicated to you. By continuing to use Mini Payments for Partner Brands, you are agreeing to the updated Terms.
14.7 In case any provision of these Terms shall be declared to be invalid, illegal, or unenforceable in any respect, the validity, legality or unenforceability of any other provision therein shall not in any way be affected or impaired thereby.
14.8 These Terms shall be construed and governed in accordance with the laws of the Philippines.
14.9 Maya Bank may modify these Terms and Conditions from time to time to comply with law or regulation, enhance customer protections, or reflect product changes. Any change will be communicated to you at least sixty (60) calendar days before it takes effect, through in-app notifications, email/SMS, our website, and/or public notice. Changes required by law/regulation or those more favorable to you or as directed by laws and regulations may take effect sooner. If you do not agree to an amendment, you may discontinue use of the affected product/service before the effective date without incurring penalties; continued use after the effective date constitutes acceptance of the amended Terms.
14.10 You understand and agree that Maya Bank may send you notices or messages, including SMS, in-app notifications, emails, to inform you of new features, enhancements, improvements, developments, functionalities, products, promotions, offers, advertisement or any other information relative to our services.
You understand that You need to exercise caution and verify the legitimacy of any notices, messages, links, or calls before acting. Cybercrimes such as smishing (SMS phishing), phishing (email or online fraud), vishing (voice phishing), and other social engineering schemes may impersonate Maya Bank or its representatives to obtain your information or prompt transactions. Maya Bank will not be liable for any loss, claim, or damage arising from or related to such cybercrimes, including actions taken in response to fraudulent communications, except to the extent caused by Maya Bank’s fraud, gross negligence, or willful misconduct.
Do not share your credentials. Never disclose OneTime Passwords (OTPs), passwords, PINs, CVVs, recovery codes, or any security codes to anyone. Maya Bank will never ask for your OTPs or passwords through SMS, email, phone calls, social media, or chat. Sharing or entering these credentials into thirdparty sites or links may result in unauthorized transactions for which you will bear responsibility if due to your negligence.
To verify messages:
- Use only the official Maya app to log in and take action—avoid clicking links in unsolicited messages. We will never send you links via SMS for you to log in, verify or transact. We will never ask for your password, OTP, PIN, or full card details via SMS
- Legitimate emails come from @maya.ph or @mayabank.ph. We may send verification emails that include a validation link only after you initiate the request inside the Maya app (e.g., verifying your email for account recovery).
- Never share sensitive data (OTP, PIN, password, CVV) by SMS/email/chat—even with someone claiming to be from Maya.
- If in doubt, do not click or reply. Contact us through official support channels inside the Maya app or via our website.
- Report suspicious communications immediately and change your password if you think it has been compromised.
14.11 You understand and agree that these Terms including all disputes relative to your use of the products or services of Maya Bank and relating to your account shall be governed by the laws of the Republic of the Philippines without regard to conflict of laws principles. In case of dispute arising out of this Terms or your use of the products or services, you agree to resolve such dispute amicably, promptly and in good faith. In case of failure to amicably resolve a dispute, a case shall be exclusively filed in the proper courts of Mandaluyong City, Metro Manila, Philippines, to the exclusion of all other courts and venue. This exclusivity of the venue is without prejudice to: (i) any specific law or rule that prescribes a different mandatory venue; and, (ii) your right to seek assistance or file a complaint with the Bangko Sentral ng Pilipinas (BSP) Consumer Assistance Mechanism or other competent regulators.
14.12 You authorize Maya Bank and its official partners to process the personal information that you have provided directly or indirectly in our data collection touchpoints relevant to the relevant purposes furnished to you in our privacy notices.
